MISSION BASED RESILIENCE – SELF-LEADERSHIP TRAINING
PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK
In consideration of participation in a HUMAN PERFORMANCE CONSULTING, LLC program also known as Mission Based Resilience: Self-Leadership Training course, its agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter referred to as HPC), I hereby agree to release, indemnify, and discharge HPC, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:
I acknowledge that my participation in the HPC program, including: resistance training, cardiovascular training, resilience training, stress exposure and other exercise and physical activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
The risks include, but are not limited to among other things such as: Strains, sprains, fractures, drowning, near drowning, heat and cold injuries including cold water shock, sun burns, dehydration, heat-related illnesses, hyperthermia and hypothermia, over-use syndrome, rapidly changing weather, lightning, injuries involving the acts or omissions of other Program participants or vehicles, animal bites and/or stings; contact with poisonous plants, aggressive/poisonous marine life, my own physical condition known or unknown, accidents involving, but not limited to, traveling to and from all locations, paddling, climbing, biking, hiking, running, walking, rucking, skiing, snow shoeing, travel by boat, truck, car or other convenience, falling from heights, heart attack, disease or illness, including COVID-19 resulting from the SARS-COV-2 virus, due to exposure to other Program participants, permanent paralysis and/or death. While particular rules, equipment and/or personal discipline may reduce this risk, the risk of serious injury and/or death does exist.
Furthermore, HPC organizers, employees and volunteers have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.
I knowingly and voluntarily agree that any advice, opinions, thoughts, coaching or consulting given to me by HPC is solely for use within the Program. Using such advice, opinions, thoughts, coaching or consulting in everyday life may have consequences that may affect the participant’s job, marriage, or life negatively and/or positively. Although the Program has a psychological component where goal setting, modifying, and changing the participant’s life through behavioral changes is positive it is up to the participant to use these tools as needed outside the Program and HPC is not responsible for the outcomes associated with such.
After the opportunity to fully inform myself about the Program, I (undersigned) knowingly, voluntarily and freely assume and accept all such risks, both known and unknown, even if arising from the negligence or act or omissions of HPC, it’s organizers, employees or volunteers. I further expressly agree and promise to accept and assume all of the risks existing in this Program. My participation in this Program is purely voluntary, and I elect to participate in spite of the risks. Additionally, I agree to comply with all local and Federal laws, rules and regulations.
I knowingly and voluntarily agree to comply with any stated customary terms and conditions for Participant’s participation in the Program. If, however, I observe an unusual and/or significant hazard during my presence at the Event, I will remove myself from participation and brings such hazard to the attention of the nearest HPC employee.
I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless HPC from any and all claims, demands, or causes of action, which are in any way connected with my participation in these activities or my use of HPC’s equipment or facilities, including any such claims which allege negligent acts or omissions of HPC.
I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
I hereby declare I am physically fit and mentally sound of mind. I do not suffer from any physical and/or mental conditions which may lead to a dangerous situation with regard to other persons or myself during Mission Based Resilience: Self-Leadership Training, resistance training, cardiovascular training, resilience training, stress exposure, other exercise, physical activities and instructional activities.
I hereby declare that I have no physical or mental condition that should preclude me from participating in my chosen activity, that I am not participating against medical advice or treatment, and that I have not been diagnosed by a registered doctor as having a terminal illness. Even if I have a heath condition as stated above of which I am unaware, by signing this form I still choose to participate in the activities and agree to waive all responsibilities to all above mentioned parties concerning any consequences that would result from my actions.
To the fullest extent permissible by applicable law, I, on behalf of myself, and my respective heirs, assigns, spouses, partners, personal representatives and/or next of kin, forever Undertake the full responsibility, release, discharge and covenant not to sue HPC and their respective owners, officers, directors, employees, contractors, representatives, agents and affiliates and, as applicable, any direct or indirect parent or subsidiary, predecessor, successor, heir, assign, media partners, associated charity, sponsor or medical providers of any of the foregoing with respect to any suits, claims, or loss and all injury, disability, death, and/or loss or damage to person or property, in connection with my participation in the Program, wither arising from the negligence or willful conduct of HPC or otherwise. I further agree to indemnify, defend and hold harmless HPC from any lossliability, cost, claim and/or damages arising from Participant’s participation in or association with the Program, including, but not limited to, reasonable attorney’s fees.
I further declare that in the event that I feel ill or unwell, have any physical complaints whatsoever or if an injury is sustained of any kind during the course of any of the above referenced activities, I will notify an HPC employee immediately and before leaving the premises and starting participation in any event.
I, on behalf of myself, consent to administration of first aid and other medical treatment and related services, including evacuation/transport, in the event of injury or illness in connection with participation in the Program and hereby release and indemnify HPC from any and all liability or claims arising out of such treatment and/or services. I further consent and agree to obtain, furnish and allow, if required, the use and disclosure of my personal health information by such providers in connection with rendering services and/or treatment, and to sign any additional documents that may be requested by such providers, in connection with such information and services.
If any of the provision of this Waiver, Release of Liability, Covenant Not to Sue shall be deemed by a court of competent jurisdiction invalid or unenforceable in any respect, then, to the fullest extent permitted by applicable law, all other provisions hereof shall remain in full force and effect.
In the event a lawsuit is initiated against HPC, I agree to do so solely in Bay County, Florida and I further agree that the procedural and substantive law of Florida shall apply in that action without regard to the conflict of law rules of Florida.
By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this Program, I may be found by a court of law to have waived my right to maintain a lawsuit against HPC.
I have read these declarations, fully understand them, and I agree to be bound by them knowing that I have given up substantial rights by signing it, and sign it freely and voluntarily.
